✅ به لحاظ قانون کار عنوان کارگر اطلاق عام داشته و اعم از کارگر روزمزد ، موقت ، ثابت ، رسمی، دایمی و غیره می باشد و طبق تعریف کارگر در ماده 2 قانون کار ،کارگر به کسی گفته می شود که تحت هر عنوان در مقابل دریافت حق السعی به درخواست کارفرما کار می کند به این معنی کلیه کارگرانی که در چهارچوب قراردادکار بامدت معین یا انجام کارمعین و یا قراردادکار غیرموقت و دایمی به کار اشتغال دارند تحت حمایت قانون کار قرار داشته و قانونا کارگر شناخته می شوند و از مزایای مقرر در این قانون و مقررات تبعی برخوردار خواهند شد و روزمزد بودن و سایر انواع مزد بری تغییری در ماهیت رابطه کارگری و کارفرمایی ایجادنمیکند.
